Products, Availability & Assembly

This website will be kept up to date as much as possible. While we aim to ensure that information on this website is correct, sometimes errors do occur for which we apologise. Some items may require some simple self-assembly, for example beds, which will be outlined in an assembly instruction sheet you will receive with your furniture. It may also be necessary to make changes to product specifications. We reserve the right to make these changes at any time and without notice.

Defects

The Customer shall inspect the Goods on delivery and shall within three (3) days of delivery (time being of the essence) notify the Manufacturer of any alleged defect, shortage in quantity, damage or failure to comply with the description or quote. The Customer shall afford the Manufacturer an opportunity to inspect the Goods within a reasonable time following delivery if the Customer believes the Goods are defective in any way. If the Customer shall fail to comply with these provisions the Goods shall be presumed to be free from any defect or damage. For defective Goods, which the Manufacturer has agreed in writing that the Customer is entitled to reject, the Manufacturer’s liability is limited to either (at the Manufacturer’s discretion) replacing the Goods or repairing the Goods.

Conditions of Guarantee

1 Our 25 year quality guarantee only applies to the original purchaser and does not apply to commercial applications.

2 This guarantee does not cover normal wear and tear, fading and soiling from prolonged direct sunlight or negligent handling and misuse.

3 The decision to repair or replace any items will be made at the discretion of Coastwood Furniture. Ranges which have since been deleted by the manufacturer will not be replaced.

4. Coastwood have the option to repair the defect or may also use an outside tradesperson to repair on our behalf.

5. Any claims made under the Guarantee must first be registered with the retailer where it was purchased. The retailer will require proof of purchase and then we will require digital pictures to be forwarded to sales@coastwoodfurniture.co.nz

6. This guarantee covers goods purchased and retained in New Zealand.

General

1.1 If any provision of these terms and conditions shall be invalid, void, illegal or unenforceable the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

1.2 These terms and conditions and any contract to which they apply shall be governed by the laws of New Zealand and are subject to the jurisdiction of the courts of New Zealand.

1.3 The Manufacturer shall be under no liability whatever to the Customer for any indirect loss and/or expense (including loss of profit) suffered by the Customer arising out of a breach by the Manufacturer of these terms and conditions.

1.4 In the event of any breach of this contract by the Manufacturer the remedies of the Customer shall be limited to damages which under no circumstances shall exceed the Price of the Goods.

1.5 The Customer shall not be entitled to set off against or deduct from the Price any sums owed or claimed to be owed to the Customer by the Manufacturer.

1.6 The Manufacturer may license or sub-contract all or any part of its rights and obligations without the Customer’s consent.

1.7 The Manufacturer reserves the right to review these terms and conditions at any time. If, following any such review, there is to be any change to these terms and conditions, then that change will take effect from the date on which the Manufacturer notifies the Customer of such change.

1.8 The provisions of the Contractual Remedies Act 1979 shall apply to this contract as if section 15(d) were omitted from the Contractual Remedies Act 1979.

1.9 Neither party shall be liable for any default due to any act of God, war, terrorism, strike, lock-out, industrial action, fire, flood, drought, storm or other event beyond the reasonable control of either party.

1.10 The failure by the Manufacturer to enforce any provision of these terms and conditions shall not be treated as a waiver of that provision, nor shall it affect the Manufacturer’s right to subsequently enforce that provision.
